What is a power of attorney?

A Power of Attorney (POA) is a legal instrument that enables an authorized individual to act on your behalf, making decisions and carrying out actions when you are unable to do so. Whether you require temporary authorization within specific parameters or comprehensive management of your business affairs in Thailand, Witsaroot L&L offers consultation and assistance in drafting the Power of Attorney tailored to your needs.

In Thailand, a valid Power of Attorney requires the signatures of both the Principal and the Attorney-in-fact, witnessed by individuals or a Notarial Services Attorney. Notarization by the Notarial Services Attorney is also possible to authenticate the signatures. Additionally, the Power of Attorney must bear the required duty stamps to be recognized as an official document for legal purposes.

It allows you to plan for incapacity, appoint someone to handle financial, legal, health, and property matters on your behalf, provides convenience and efficiency, and grants specific authority for specialized needs. A POA ensures that your affairs are managed according to your wishes and offers peace of mind in challenging circumstances.

A Power of Attorney (POA) provides people not only with peace of mind but control after unpredictable events. This legal document allows a person to appoint an agent to make decisions about finances and health care and manage those affairs should the person become unable to do so.

The advantages of a POA include decision-making authority, incapacity planning, convenience and efficiency, continuity of affairs, and tailored authority to meet specific needs. A POA provides peace of mind, protects your interests, and allows for effective management of your affairs by a trusted agent.

Here is the list of frequently notarized documents:

Frequently notarized documents

  • Copy of passport or ID card
  • Birth, marriage, or death certificates
  • Educational degree or certificates

However, Witsaroot L&L can guide you through the specific requirements for notary services and facilitate the certification process with the relevant authorities in Thailand.

Frequently asked questions

Notarization is the process of having a notary public or a qualified attorney certify the authenticity of a document or the signature(s) on a document. The notary public verifies the identity of the signatories, confirms that they are signing willingly and knowingly, and ensures that the document is executed in accordance with applicable laws and regulations. The notary then affixes their official seal or stamp to the document, providing a level of authenticity and credibility to the document for use in legal and official matters.

Notarization adds authenticity, credibility, and legal recognition to documents by verifying identities, deterring fraud, and ensuring compliance with legal requirements. Notarized documents are widely accepted, especially for international use, and play a crucial role in various legal transactions.

A signing agent is a specialized individual, often a notary public, who is authorized to facilitate the signing of important documents, particularly those related to real estate transactions. Signing agents are trained to ensure that the signatories understand the documents they are signing and that the process is executed correctly and in compliance with applicable laws. They may also be responsible for notarizing certain documents during the signing process. The role of a signing agent is to act as a neutral and impartial party, providing assistance and expertise to ensure a smooth and legally compliant signing experience.
