Malaysia – Labuan offshore company

Labuan is an offshore, Malaysian island, which has the benefit of low tax regimes while still retaining the protection of Malaysia’s laws and regulations.

If the Malaysian company is registered as a Labuan Offshore company, the company search report information is limited and will not include shareholder details, director details, share capital or financial information.

Chinese Legal Representative

For foreign companies in China, a legal representative must be appointed. This person is to act on behalf of the company, generally regarding signing contracts and submitting reports to the regulators.

This person may also be a director and/or shareholder of the company if necessary.

Financial Statements

Companies in China must prepare and submit financial statements to a number of governing bodies such as the local Finance Bureau, local offices of State Administration and Industry of Commerce, State Administration of Taxation and the Foreign Exchange. These financial statements must be audited and submitted to the relevant authorities within 6 months of the year end – following the fiscal year from 1 January to 31 December.

According to new rules, the Ministry of Land and Resources guides and monitors the real estate registration system all over the country. A permanently acting register is being established.

Establishment of the Land Register dates back to the period of Japanese occupation of the Korean Peninsula. In 1960, already after proclamation of independence, the Law on Real Estate Registration was adopted in the Republic of Korea. The registration system is under the jurisdiction of the Ministry of Justice of the Republic of Korea. Registration authorities include special departments at the Supreme court, local courts, industry-specific courts and – 151 individual registration bureaus. Real estate record is maintained in Land Registers containing approximately 45 million records..

The cadastral system also began to be established back in early ХХ century, however, the Law on Cadaster was adopted in 1950. The Cadaster includes 100% of the territory of the Republic. Cadasters include approximately 32 million records and over 750 thousand cadastral maps.

For the purpose of efficient use of cadastral information, the Cadastral Land Data System was established in the Republic of Korea.

In 1980-s – 2000-s real estate registers in South Korea were computerized. Since then they have been maintained both in paper and in electronic form.
